Course Outline:

In OBG Ltd. v. Allan the majority of the English Law Lords has rejected an extension of the tort of conversion to contractual rights on the basis that historically the tort of conversion is a tort against a person’s interest in a chattel.  The decision has been widely and controversially discussed.  This seminar explains the background, considers the judgment in a wider context and offers a new perspective by focusing on the property law features involved.

Key points covered:

  • Terminological and doctrinal basics of tort law, contract law and property law
  • The interaction between contract law, tort law and property law
  • The historical development of the tort of conversion
  • The scope of protection of the tort of conversion
  • Lumley v. Gye
  • OBG Ltd. v. Allan
  • Practical implications of the re-assessment of tort of conversion
