Presenter's Profile:
Prof. Steven Gallagher

Steven Gallagher was awarded a first class LL.B.  He was called to the Bar of England and Wales in 2006.  Steven teaches equity and trusts, property law, and a course on art, antiquities, cultural heritage and the law.  In September 2023, Steven began teaching a new course on digital technology and law.  Steven has presented over 200 continuing professional development courses for solicitors in Hong Kong on many topics associated with property.  Steven’s research interests include equity and the law of trusts, cultural heritage law, Chinese custom and law, and legal history.  In 2023, Steven published a textbook on Digital Technology and Law.  He is not a technologist.

Course Outline:

This 3-hour seminar will provide an introduction to the law which may protect cultural heritage in Hong Kong.  The seminar will begin by considering what is meant by the term “cultural heritage” and then continue by considering what may constitute cultural heritage in Hong Kong.  The seminar will then consider the law which may protect this cultural heritage in Hong Kong and the issues that have arisen with regard to cultural heritage protection in Hong Kong.  The seminar will consider built heritage, Hong Kong’s part in the illicit trade in cultural heritage, in particular the illicit trade in antiquities looted from China, and Hong Kong’s intangible cultural heritage.  Issues that will be considered included the Queen’s Pier, Ho Tung Gardens, HMS Tamar and the mummified monk in the ancient Buddha statue.

Some of the topics considered in this seminar will be:

  • What is cultural heritage?
  • What is cultural heritage law?
  • Has Hong Kong got any cultural heritage?
  • What laws may protect cultural heritage in Hong Kong?
  • How have these laws developed?
  • Are these laws effective?
  • The Queen’s Pier;
  • Ho Tung Gardens;
  • HMS Tamar;
  • Hong Kong’s part in the illicit trade in antiques and antiquities;
  • The curious case of the mummified monk in the ancient Buddha statue;
  • Intangible cultural heritage protection in Hong Kong;
  • The future for the protection of cultural heritage in Hong Kong.
